Sheriff’s sale set for Tuesday at Dickens courthouse

On Tuesday, Aug. 7, 2018,

at 10 a.m. in the foyer of the Dickens County Courthouse Annex, a sheriff’s sale of 18 Dickens County properties in a state of tax delinquency is scheduled.

According to Dickens County Judge Kevin Brendle, the sheriff’s sale will be an auction conducted by the county’s tax attorneys, and each lot and each corresponding set of mineral rights will be auctioned separately.

Dickens County Tax Attorney Adam Walker with Perdue, Brandon, Fielder, Collins and Mott, LLC explained some of the components of the Sheriff’s Sale. “It will be a live auction, and you must be present to participate. We will accept no phone bids or no computer bids. If there is someone there in your stead, they must have power of attorney.”

Walker said that either he or attorney Tony Ellison also with Perdue, Brandon, Fielder, Collins and Mott, LLC, would act as auctioneer. According to Walker, the opening bids for each property are the lowest dollar value of one of two options: 1. Taxes, penalties, court costs, research fees, filing fees, sheriff’s fees, attorney ad litem fees and publication costs or 2. The latest appraisal value. Whichever of those two amounts is lowest will be the opening bid price.

At the auction, buyers must have cash or certified funds, and the payment is due immediately after the sale. Civil penalties will be applied to anyone not fulfilling the agreed to sale. Brendle said that the properties to be auctioned at the sale were determined by their state of delinquency.

All properties have three years of back taxes owing, and the county’s tax attorneys have tried to collect taxes, notify property owners and heirs, and arrange tax payment plans, if needed, on these properties.

Efforts to collect back taxes did not yield results, and therefore, the properties are offered up at the sheriff’s sale.
