In a special called meeting of the Patton Springs Independent School District board on May 5, Andrews Consulting Firm of Rockwall, Texas, presented information for the firm’s clients H E Cottonwood Solar, LLC. Fred Stormer presented Chapter 313 agreement information.
Board member Ernest Ramirez made the motion that the board adopt District Policy CCGB (LOCAL) as presented, relating to the Texas Economic Development Act, Chapter 313 of the Texas Tax Code, and authorize the superintendent to take all action necessary to incorporate this policy into the district’s policy manual. Clayt Bridge seconded. The motion passed.
David Keith then made the motion that the district hire the Underwood Law Firm, P.C., as special legal counsel to provide professional services relating to consideration of Applications for Appraised Limitation on Qualified Property, and to negotiate and draft any resulting Agreement for Limitation on Appraised Value on behalf of the district, and authorize the board president to sign the engagement letter with the Underwood Law Firm to secure such services. Ramirez made the second. The motion passed.
Ramirez made the motion that the board (1) accept for consideration H E-Cottonwood Solar’s LLC Application for an Appraised Value Limitation on Qualified Property; (2) set a standard application fee of $80,000 for such application; and, (3) authorize the superintendent to acknowledge receipt of the application and application fee, review the application and, upon a determination that such application is complete, work with the Underwood Law Firm to submit the application to the Comptroller as set out in Chapter 313 of the Texas Tax Code. David Keith made the second. Motion passed.
Bridge made the motion and Ramirez made the second to approve the budget amendment as presented. The motion passed.
Attending the meeting were board members Gary Bridge, Clayt Bridge, David Keith and Ernest Ramirez. Also attending were superintendent Bryan White and business manager Becky Hodges. Also in attendance were Garrett Peters, K.E. Andrews Consulting; and Fred Stormer, attorney, Underwood Law Firm.
